Terms and Conditions
IMPORTANT! By accessing and using the www.centum.ca website (the Site), you are
agreeing to the following terms and conditions and to the Privacy Policy available
elsewhere on the Site. These terms and conditions and the Privacy Policy may be
changed from time to time, and it is your responsibility to check back regularly
to inform yourself of such changes. Your continued use of the Site following the
posting of changes to these terms will be deemed as your acceptance of all such
changes. If you do not agree to these terms and conditions, you must immediately
stop accessing and using the Site.
Background
This is an agreement between you and Centum Financial Group Inc. (CENTUM), and describes
the terms and conditions applicable to your use and access of the Site.
About CENTUM
CENTUM is part of a group of franchise organizations that includes financial, real
estate and travel businesses. CENTUM grants franchises to operate mortgage brokerage
businesses to certain qualified independent businesses but does not itself provide
mortgage broker services. Each CENTUM franchise is an independently owned and operated
mortgage broker business.
Permitted Use
You are only authorized to visit, view and to retain a single copy of pages of the
Site for your own personal use. You shall not duplicate, download, publish, modify
or otherwise distribute any of the information, reports, data, graphics, trade-marks,
text, files, software, product or company names, trade-marks or trade-names listed,
contained, embedded or otherwise present on this Site from time to time (collectively,
the "Content") for any purpose. Additionally, you shall not, without CENTUM's prior
written permission, remove or modify any legal notices or credits which may be present
on the Site, link or post links to any subdirectory of the Site or frame any portion
of the Site.
Franchisee and External Links
The Site contains links to websites operated by CENTUM franchisees (each a "Franchisee")
and to third party websites. CENTUM cannot and does not make any guarantees, representations,
warranties or endorsements with respect to the content contained or services available
on such websites (including, without limitation, any guarantees or representations
with respect to the accuracy of the information contained on such websites, the
reliability of such websites, the suitability for a particular purpose of such websites
or the absence of any viruses, bugs or other disabling material on such websites
which may adversely affect the operation of your computer or other software). By
using the Site to link to another website, you understand and agree that CENTUM
will not be liable for any damages or losses resulting or arising from your use
of such other websites. If you are interested in establishing a link from your website
to our home page, or if you wish to publish or post our name, logo or other references

Access and Interference
You shall not use any robot, spider or any other device or process to monitor or
copy the Site or the Content without CENTUM's prior written permission, and also
shall not use any device, software or routine to interfere or attempt to interfere
with the proper operation of the Site or, where applicable, the Content.
Limitation of Liability and Disclaimer
USE OF THIS SITE AND CONTENT IS SOLELY AT YOUR OWN RISK. CENTUM provides the Site
and the Content on an "as-is, where-is" basis, and does not represent, warrant or
guarantee that the Site or the Content will be free of errors, viruses, worms or
other disabling material which may adversely affect the operation of your computer
or other software or that the Site will function on an uninterrupted basis. CENTUM
expressly disclaims all warranties, express or implied, with respect to the Site
and the Content, including, without limitation, any implied warranties of merchantability,
fitness for a particular purpose or ownership and non-infringement of the Content.
NEITHER CENTUM NOR ANY FRANCHISEE SHALL BE LIABLE FOR ANY LOSS OR DAMAGES OF ANY
KIND (INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE AND/OR
CONSEQUENTIAL DAMAGES) ARISING OUT OF OR IN CONNECTION WITH THE USE OR ACCESS OF
THIS SITE OR THE CONTENT, WHETHER SUCH LOSS OR DAMAGE ARISES OUT OF CONTRACT, TORT
(INCLUDING NEGLIGENCE) OR ANY OTHER THEORY OF LIABILITY OR RESPONSIBILITY.
Ownership
The Content and the Site are the property of CENTUM and/or its suppliers and trade
partners and are protected by Canadian and international copyright, trade-mark and
other laws. The CENTUM trade-mark and logo are trade-marks of CENTUM. Except as
expressly permitted in these terms and conditions, you shall not copy, transmit,
display, distribute, license, alter, frame or otherwise use in whole or in part
in any manner any of the Content. Other featured words or symbols used to identify
the source of goods and services are the trade-marks of their respective owners.
Content
As CENTUM cannot and does not represent, warrant or guarantee that the Site or the
Content will be free from errors, viruses, worms or other disabling devices, you
should take, and represent and warrant that you have taken, reasonable and appropriate
precautions to scan for computer viruses. You should also ensure that you have,
and represent and warrant that you have, a complete and current backup of the information
contained on your computer prior to using or accessing the Site or the Content.
Privacy
CENTUM believes your privacy is important. Please review CENTUM's Privacy Policy
which applies to all information transmitted by you or gathered by CENTUM through
your use of the Site. Any information transmitted to CENTUM by you other than specific
information about you will be treated by CENTUM as non-confidential and non-proprietary,
and you authorize CENTUM to distribute, reproduce and otherwise use such information
as CENTUM considers appropriate.
Choice of Law
Your access to and use of Site, these terms and conditions and the Privacy Policy
are governed in all respects by the laws of British Columbia, and any disputes arising
out of or in connection with the Site will be heard in the courts of Vancouver,
British Columbia.
You shall indemnify and hold CENTUM and each Franchisee (and their respective subsidiaries,
affiliates, officers, agents and other partners and employees) harmless from any
loss, liability, claim or demand, including reasonable legal fees, made by any third
party due to, or arising out of, your use and access of the Site.
Online Applications to Franchisees
Information contained in mortgage applications, online or otherwise, is submitted
to enable CENTUM to consider a mortgage loan, and is to my best knowledge and belief
a true statement of my affairs. In submitting this information I/We consent to CENTUM,
CENTUM Franchisees, and / or any of its agents or assigns, obtaining such credit
reports and other information necessary at any time in connection with the application
made for a mortgage loan and to the disclosure of any personal and credit information
concerning the undersigned to any credit reporting agency, financial institution
or corporation for the purpose of mortgage approval, funding and ongoing account
management. I/We also consent to receive periodic mortgage account information as
well as mortgage and real estate related promotional or informational material.
Miscellaneous
If any provision of this Agreement is held by a court of competent jurisdiction
to be invalid or unenforceable, such provision shall be severed and the remaining
provisions shall remain in full force and effect. Headings are for reference purposes
only and in no way define, limit, construe or describe the scope or extent of such
section. CENTUM's failure to act with respect to a breach by you or others does
not waive CENTUM's right to act with respect to subsequent or similar breaches.
This Agreement sets forth the entire understanding and agreement between you and
